Terms and Conditions for Budget Planner (Beta)

Effective Date: May 2, 2025

Welcome to Budget Planner!

These Terms and Conditions ("Terms") govern your access to and use of the Budget Planner web application and related services (collectively, the "Service"), provided by Muhammad Ali Raza ("we," "us," "our"). Budget Planner is currently offered in a beta testing phase ("Beta Phase") as a paid service.

By purchasing access, registering for an account, or using the Service, you ("you," "your," "User") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not purchase access or use the Service.

1. BETA SERVICE ACKNOWLEDGEMENT

You understand and acknowledge that even though you are paying for access:

• Beta Version: The Service is a beta version and is provided for testing and evaluation purposes. It may not be complete, may contain errors, bugs, inaccuracies, or vulnerabilities, and may undergo significant changes before a final release, or may never be released commercially beyond the Beta Phase.
• "As Is" Basis: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. Purchasing access does not imply any warranty beyond what is stated in these Terms.
• Potential for Data Loss: Due to the nature of beta testing, there is a risk of data loss or corruption. You are solely responsible for backing up any data you enter into the Service. We are not liable for any loss or corruption of your data.
• Changes and Interruptions: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, including during the Beta Phase. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service, except as may be explicitly stated regarding refunds (see Section 4).
• Feedback: As part of the Beta Phase, you may be invited or choose to provide feedback, suggestions, or reports ("Feedback"). You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our Service or other products/services without any obligation to you.

2. FEES AND PAYMENT (BETA LIFETIME ACCESS)

• Beta Fee: Access to the Service during the Beta Phase requires a one-time payment ("Beta Fee").
• Payment: You agree to pay the Beta Fee through the payment methods offered on our website. You authorize us (or our third-party payment processor) to charge your chosen payment method for the Beta Fee.
• Lifetime Access: Payment of the Beta Fee grants you "Lifetime Access." This means you will have access to the core features and functionalities of the Budget Planner Service, including subsequent updates and improvements to those core features, for as long as the Budget Planner Service is actively maintained and commercially offered by Muhammad Ali Raza.
• Lifetime Access Limitations: "Lifetime Access" does not guarantee:
  • Access to entirely new, separate premium modules, add-ons, or distinct services that may be offered in the future under different terms or pricing.
  • The Service will be operated indefinitely. If Muhammad Ali Raza ceases to operate the Budget Planner Service entirely, access will terminate.
  • Specific uptime levels or uninterrupted service, especially during the Beta Phase.
• Taxes: You are responsible for any applicable taxes (like sales tax, VAT, or GST) associated with your purchase, based on your location. The price may or may not include such taxes, which should be clarified during the checkout process.

3. FUTURE PRICING (POST-BETA)

• Subscription Model: We plan to offer the Service to new users under a recurring subscription model after the official launch concludes the Beta Phase.
• Beta User Exemption: Users who have purchased the Beta Lifetime Access by paying the Beta Fee will not be required to pay the future recurring subscription fees for continued access to the core features covered by their Lifetime Access plan.
• Optional Future Purchases: Beta Lifetime Access users may have the option, but not the obligation, to purchase separate, new premium features, modules, or services if and when they are introduced post-beta.

4. REFUND POLICY (BETA)

All payments of the Beta Fee for Beta Lifetime Access are final and non-refundable, except where required by applicable consumer law in Pakistan. By purchasing Beta Lifetime Access, you acknowledge and agree that you are paying for early access to a beta product with inherent risks (as outlined in Section 1) and that refunds will not typically be provided based on dissatisfaction with features, bugs, or changes made during or after the Beta Phase.

5. ACCOUNT REGISTRATION

• To use the Service after payment, you must register for an account.
• You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
• You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
• You must be at least 18 years old to purchase access and use the Service.

6. USE OF THE SERVICE

• License: Subject to your compliance with these Terms and payment of the Beta Fee, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for the duration defined by your purchased access (i.e., Lifetime Access for beta users), solely for your personal, non-commercial budgeting and financial planning purposes.
• Functionality: The Service allows you to input and track monthly income, expenses, bills, and savings. The calculations and summaries provided are based solely on the data you enter.
• User Responsibilities:
  • You are solely responsible for the accuracy, completeness, and legality of the data you input into the Service ("User Content").
  • You are responsible for your financial decisions. The Service is a tool for informational purposes only.
• Prohibited Conduct: You agree not to engage in illegal use, reverse engineering, or other prohibited activities.

7. USER CONTENT & PRIVACY

• Your Data: You retain ownership of your User Content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify (for formatting/display), and process your User Content solely to the extent necessary to provide, maintain, and improve the Service.
• Privacy: Our collection and use of your personal information, including financial data entered as User Content, is described in our Privacy Policy. Please review it carefully. You acknowledge that while we implement security measures, no system is impenetrable, especially during a Beta Phase, and we cannot guarantee absolute security.

8. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the Service (excluding User Content), including all associated intellectual property rights, are and will remain the exclusive property of Muhammad Ali Raza and its licensors.

9. DISCLAIMERS

• NO FINANCIAL ADVICE: THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL, INVESTMENT, LEGAL, TAX, OR OTHER PROFESSIONAL ADVICE, REGARDLESS OF ANY FEE PAID. YOU SHOULD CONSULT WITH QUALIFIED PROFESSIONALS BEFORE MAKING ANY FINANCIAL DECISIONS. WE ARE NOT A FINANCIAL PLANNER, BROKER, OR TAX ADVISOR. YOUR USE OF THE SERVICE AND RELIANCE ON ANY INFORMATION PROVIDED IS SOLELY AT YOUR OWN RISK.
• BETA SERVICE DISCLAIMER: AS STATED IN SECTION 1, THE SERVICE IS A BETA VERSION PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EVEN THOUGH IT IS A PAID SERVICE DURING BETA. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED.
• DATA ACCURACY: We are not responsible for the accuracy, completeness, or timeliness of the financial data you enter.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MUHAMMAD ALI RAZA, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• ANY CONTENT OBTAINED FROM THE SERVICE;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR
• BUGS, ERRORS, OR INACCURACIES WITHIN THE BETA SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) TWELVE US DOLLARS ($12.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO US FOR ACCESS TO THE SERVICE (I.E., THE BETA FEE PAID FOR LIFETIME ACCESS).

THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Muhammad Ali Raza and its affiliates, officers, agents, employees, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Service or User Content, (ii) your violation of these Terms, or (iii) your violation of any third-party right.

12. TERMINATION

• By You: You may stop using the Service at any time. You can request account deletion via contacting support at support@budgetplanner.pro. Termination by you does not entitle you to a refund of the Beta Fee paid.
• By Us: We may suspend or terminate your access to and use of the Service, at our sole discretion, at any time and without notice or liability to you, for reasons including, but not limited to:
  • Your breach of these Terms.
  • Failure to pay applicable fees (primarily relevant for future subscription users, but could apply if initial Beta Fee payment fails or is charged back).
  • Extended periods of inactivity.
  • Our discontinuation of the Service (in which case provisions regarding Lifetime Access apply).
  • Suspected fraudulent, abusive, or illegal activity.
• Effect of Termination: Upon termination, your license to use the Service will cease. We may delete your account and User Content. Termination does not relieve you of any obligations arising prior to termination and does not entitle you to refunds unless explicitly stated otherwise or required by law. Sections 1, 2 (regarding limitations), 3 (regarding Beta User exemption), 4, 7, 8, 9, 10, 11, 12, 13, 14, and 15 shall survive termination.

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes (including potentially to future pricing models for new users or features), we will provide notice through the Service interface, by email, or other reasonable means. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms. For beta users with Lifetime Access, changes will not impose new recurring fees for the core features covered by their original purchase. If you do not agree to the changes, you must stop using the Service.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Punjab, Pakistan, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Lahore, Punjab.

15. MISCELLANEOUS

• Entire Agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service and supersede all prior agreements or understandings.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may freely assign or transfer these Terms without restriction.

By completing the purchase process for Beta Lifetime Access and/or accessing or using the Budget Planner Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
